§ 11. Notices.

  • Except in emergencies, all notices by either the City or the Company to the other shall be made by personal delivery, depositing such notice in the U.S. Mail, Certified Mail, return receipt requested, or by facsimile. Any notice served by Certified Mail, return receipt requested, shall be deemed delivered five (5) calendar days after the date of such deposit in the U.S. Mail unless otherwise provided. Any notice given by facsimile is deemed received by the next business day. "Business day" for purposes of this section shall mean Monday through Friday, City and SBC Kansas observed holidays excepted. Emergency notices shall be provided by telephone, with written notice immediately following by facsimile.

    Notices shall be addressed to the City as follows:

    Notice to SBC Kansas shall be addressed to the Company as follows:

    Southwestern Bell Telephone L.P.
    Barb Schmidtlein Area Manager-External Affairs

    Topeka, Kansas 66603

    Notice shall be given as required by the terms of this contract franchise ordinance. Notice shall be provided to the above-named addressees unless directed otherwise in writing by City or SBC Kansas. Both SBC Kansas and the City shall provide to the other contract information with telephone and facsimile number for use in emergencies.
