AN ORDINANCE GRANTING TO AT&T COMMUNICATIONS, INC., THE RIGHT AND PRIVILEGE TO CONSTRUCT, OPERATE, AND MAINTAIN A FIBER OPTIC TELECOMMUNICATION SYSTEM IN THE CITY OF WICHITA, KANSAS, PRESCRIBING THE TERMS OF SAID GRANT AND RELATING THERETO.

WHEREAS, AT&T Communications, Inc., as agent for the American Telephone and Telegraph Company and for AT&T Communications of the Southwest, Inc., hereinafter referred to as "AT&T," desires to use certain public right-of-way of the City of Wichita for the purpose of construction, maintenance, and operation of a fiber optic telecommunication system pursuant to the provisions of the laws of the State of Kansas; and

WHEREAS, the City of Wichita finds such use to be in the public interest and is willing to enter into an agreement to allow AT&T to use the public right-of-way for such purpose; and

WHEREAS, the Agreement giving such right and privilege is to be granted by ordinance pursuant to K.S.A. 12-2001, et seq.,

NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:
