  • A CHARTER ORDINANCE AMENDING AND REPEALING CHARTER ORDINANCE NO. 9 OF THE CITY OF WICHITA, KANSAS; EXEMPTING THE CITY OF WICHITA, KANSAS FROM K.S.A. 79-1949; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT; AND REMOVING ANY LIMITATION OF TAX LEVY.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. That Charter Ordinance No. 9 of the City of Wichita, Kansas, is hereby repealed.

    SECTION 2. That the governing body of the City of Wichita, Kansas, by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to and exempts itself from and makes inapplicable to it K.S.A. 79-1949, which applies only to cities of the first class having a population of more than 150,000, and applying to said City, and to provide substitute and additional provisions as hereinafter provided.

    SECTION 3. That the governing body of the City of Wichita, Kansas, is hereby authorized and empowered to levy taxes in each year for the following city purposes; provided, that city purposes specifically authorized by other statutes are not excluded herein because of enumeration. That said levy shall be on each dollar of assessed tangible valuation of said city for the following purposes:

    General Government, including but not limited to: Protection of life and property; health and sanitation; highways; judgments; war service memorial; bridge; building, rebuilding and repairing; and sewage disposal.

    Special Provisions of General Government, including but not limited to: Recreation, airports, forestry and playgrounds; library, public health nurse association; charity, association aid.

    Said governing body may levy an amount necessary in accordance with the requirements of its adopted budget. That any levy limit previously contained in K.S.A. 79-1949 is hereby removed and that there be no aggregate levy limit.

    SECTION 4. That this ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

    SECTION 5. That this is a charter ordinance and shall take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed and a referendum held on this ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of Kansas, in which case the ordinance shall become effective if approved by a majority of the electors voting thereon.

    PASSED BY THE BOARD OF COMMISSIONERS, not less than two-thirds of the members-elect voting in favor thereof, this 29th day of May, 1967.
