  • A CHARTER ORDINANCE REPEALING CHARTER ORDINANCES 95 AND 96, EXEMPTING THE CITY OF WICHITA, KANSAS, FROM THE PROVISIONS OF K.S.A. 41-2622, 41-2702, 41-2703(c), 41-310 AND AMENDMENTS THERETO, AND REPEALING SECTIONS 4.16.185 AND 4.08.101 OF THE CODE OF THE CITY OF WICHITA, KANSAS, AND ESTABLISHING A SCHEDULE OF FEES FOR ALCOHOLIC LIQUOR AND CEREAL MALT BEVERAGE LICENSES FOR THOSE LICENSES AUTHORIZED BY TITLE 4 OF THE CODE OF THE CITY OF WICHITA, KANSAS.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. The City of Wichita, Kansas a commission-manager city of the first class by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt itself from, and make inapplicable to it, the provisions of K.S.A. 41-2622, 41-2702, 41-2703(c), and 41-301 and provide substitute provisions as hereinafter set forth in this ordinance. Such referenced provisions are either enactments or a part thereof which are applicable to this city, but are not applicable uniformly to all cities.

    SECTION 2. License fees for all alcoholic liquor and cereal malt beverage licenses authorized by Title 4 of the Code of the City of Wichita, Kansas, shall be established by resolution of the City Council, and shall be effective when such resolution is adopted and shall remain in effect until changed by resolution.

    SECTION 3. Applications for all licenses under Chapter 4.16 shall be upon forms prescribed and furnished by the City Treasurer's Office and shall be filed in triplicate and shall be accompanied by the appropriate license fee and evidence that the applicant possesses a valid State license.

    SECTION 4. (Amended and repealed—See Charter Ordinance No. 153, §§ 1 and 2.)

    SECTION 5. Charter Ordinances No. 95 and 96, and Sections 4.16.185 and 4.08.010 of the Code of the City of Wichita, Kansas, are hereby repealed.

    SECTION 6. This ordinance shall be published once each week for two consecutive weeks in the official City paper.

    SECTION 7. This is a Charter Ordinance and shall take effect sixty-one (61) days after final publication unless a sufficient petition for referendum is filed and a referendum held on the ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of the State of Kansas, in which case, the ordinance shall become effective if approved by a majority of the electors voting thereon.
