  • A CHARTER ORDINANCE ESTABLISHING THAT CITY COUNCIL MEMBERS SHALL BE NOMINATED AND ELECTED FROM DISTRICTS, EXEMPTING THE CITY OF WICHITA, KANSAS, FROM K.S.A. 25-2110, 25-2110a, K.S.A. 12-1003, AND 12-1006 AND REPEALING CHARTER ORDINANCE NO. 93.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    It is the intent of this Charter Ordinance to exempt the City of Wichita, Kansas, from only those sections of the Commission-Manager form of government explicitly set out herein and to remain under all other provisions of K.S.A. 12-1001 through 12-1020, except when modified by other ordinances.

    The City of Wichita, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it the provisions of K.S.A. 25-1110, 25-1110a and K.S.A. 12-1003, and 12-1006 and provide substitute and additional provisions as follows:

    SECTION 1. Composition. Commencing with the election to be held in 1989, City Council members from districts I and III shall be nominated and elected from districts. Commencing with the election of 1991 City Council members from the remaining Districts shall be nominated and elected from districts. Each Council district shall be represented by one (1) Council member.

    SECTION 2. Eligibility. Any person desiring to become a candidate for City Council member shall file with the City Clerk before the filing deadline a statement of such candidacy on a form furnished by the City Clerk. The City Clerk shall record the same and transmit it, together with the filing fee or petition, forthwith to the Sedgwick County Election Commissioner.

    Each such filing shall be accompanied by a filing fee of ten dollars ($10.00); or, in lieu of such filing fee, by a petition signed by fifty (50) qualified electors of the Council district for which the petition is filed.

    SECTION 3. Qualifications. Each Council member shall be a citizen of the United States, a qualified elector, and a resident of the City of Wichita and their respective district at the time of filing for election and thereafter for the duration of their term.

    SECTION 4. Election and Terms.

    A. Time of Primary and General Elections. The primary City election shall be held on the Tuesday preceding by five (5) weeks the first Tuesday in April of every odd-numbered year, and the general City election shall be held on the first Tuesday in April of odd-numbered years, both elections to be conducted in the manner prescribed in this Charter Ordinance and applicable state law.

    B. Primary Elections. A primary election shall be held for the purpose of nominating two candidates for any office for which more than two candidates have filed in any election year.

    In a primary election for a district Council member each qualified elector who is a resident of a district shall be entitled to vote for one candidate from that district. The two (2) candidates from each district receiving the greatest number of votes shall be placed on the general election ballot for the district in which they were nominated.     SECTION 5. General Elections. In a general election for a district Council member each qualified elector who is a resident of a district shall be entitled to vote for one candidate from that district. The candidate from each district receiving the greatest number of votes cast shall be elected as Council member from that district.

    SECTION 6. (Amended and repealed—See Charter Ordinance No. 130, § 1.)

    SECTION 7. Council Districts. The initial districts from which district Council members I and III shall be nominated and elected in 1989 shall be those established by the commission of electors and adopted by ordinance by the City Council in accordance with Charter Ordinance No. 93. Commencing in 1991, districts from which council members shall be nominated and elected shall be those established in accordance with the provisions as set forth in this Charter Ordinance.

    SECTION 8. (Amended and repealed—See Charter Ordinance No. 173, § 1.)

    SECTION 10. Repeal. Charter Ordinance No. 93 of the City of Wichita, Kansas, is hereby repealed.

    SECTION 11. Publication. This Charter Ordinance shall be published once each week for two consecutive weeks in the official City newspaper.

    SECTION 12. Election. This is a charter ordinance and is hereby made subject to a vote of the electors of the City of Wichita, Kansas. It shall take effect only if approved by a majority of the electors voting thereon.

    PASSED by the governing body, not less than two-thirds of the members elect voting in favor thereof, this 6th day of September, 1988.
