  • A CHARTER ORDINANCE ENDING SECTIONS 1 AND 2 OF CHARTER ORDINANCE NO. 117 CREATING THE POSITION OF MUNICIPAL COURT ADMINISTRATOR AND PERTAINING TO ADMINISTRATION OF THE COURT AND COURT PERSONNEL AND REPEALING THE ORIGINALS OF SAID SECTIONS.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. Section 1 of Charter ordinance No. 117, amending Section 2 of Charter Ordinance No. 90, is hereby amended to read as follows:

    "The judicial power of the City shall be vested in the Municipal Court of not less than three judges and composed of a like number of divisions, to be known respectively as division numbers one, two, and three. The City Council shall designate one of the Municipal Court judges to serve as the presiding judge in charge of the administration of the judicial functions of the court who shall serve at the pleasure of the City Council."

    SECTION 2. Section 2 of Charter ordinance No. 117, amending Section 12 of Charter Ordinance No. 90, is hereby amended to read as follows:

    "(a) The City of Wichita shall establish the position of Municipal Court Administrator. The Municipal Court Administrator which shall be responsible for directing the administrative, non-judicial operations of the Municipal Court, Clerk of the Municipal Court, Chief Probation Officer, Warrant Officers and who shall be responsible to the Administrative Judge for implementation of the policies of the court regarding judicial functions. The City shall also establish the position of Clerk of the Municipal Court and Chief Probation Officer. The organization, functions and duties of the Municipal Court Administrator, Clerk of the Municipal Court, and Chief Probation officer shall be set forth in an ordinance by the City Council."

    SECTION 3. The originals of Sections 1 and 2 of Charter Ordinance No. 117 are hereby repealed.

    SECTION 4. This ordinance shall be published once a week for two consecutive weeks in the official city newspaper.

    SECTION 5. This is a Charter Ordinance and shall take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed and a referendum held on the ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of the State of Kansas, in which case the ordinance shall become effective if approved by a majority of the elector voting thereon.

    PASSED BY THE GOVERNING BODY, not less than two-thirds of the members elect voting in favor thereof, this 24th day of September, 1991.
