  • A CHARTER ORDINANCE AMENDING AND REPEALING CHARTER ORDINANCE NO. 133, OF THE CITY OF WICHITA, KANSAS: PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT RELATING TO EXEMPTING THE CITY OF WICHITA, KANSAS FROM THE PROVISIONS OF SECTION 13-1024C, KANSAS STATUTES ANNOTATED THAT RELATES TO ISSUANCE OF GENERAL OBLIGATION BONDS TO PAY FOR PUBLIC IMPROVEMENTS.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. The governing body of the City of Wichita, Kansas by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to and exempts itself from, and makes inapplicable to it the provisions of K.S.A. 13-1024C and amendments thereto, and provides substitute and additional provisions as hereinafter set forth in this Charter Ordinance. K.S.A. 13-1024C contains provisions which are applicable to this City, but are not applicable uniformly to all cities.

    SECTION 2. The City of Wichita, Kansas is hereby authorized to issue General Obligation Bonds of the City without an election for the purpose of paying for the construction, purchase or improvement of any public improvement, including the land necessary therefore, and for the purpose of rebuilding, adding to or extending the same as the necessities of the City may require and for the purpose of paying for mobile radio equipment, library, book mobiles and equipment therefore. Such bonds shall be issued, registered, sold, delivered and retired in accordance with the provisions of the general bond law. The provisions of this Charter Ordinance are supplemental to all other state statutes, charter ordinances and ordinances relating to such improvements and, subject to limitations hereof, shall not be construed to prevent the City from using other available state statutes, charter ordinances and ordinances. For purposes of this charter ordinance, the term "public improvement" shall mean any improvement, including the land necessary thereto, that when constructed, purchased, improved, rebuilt, extended or added to, will serve a public purpose, specifically including along with all other public improvements the construction, purchase, including the land necessary thereto, improvement, rebuilding, extending or adding to convention facilities, including a hotel with meeting rooms that supplement existing convention facilities that are connected to or are located adjacent to such existing convention facilities, which hotel and meeting rooms will be owned by the City of Wichita, Kansas or owned in part by the City of Wichita, Kansas and in part by a private developer or other governmental agency, when it is found by the governing body that the convention hotel and/or meeting room project being considered will serve a public purpose.

    SECTION 3. Nothing herein contained shall be construed in a manner that would exempt the City of Wichita, Kansas in the issuance of bonds pursuant to the authority contained herein from the bonded and debt limitation set forth in K.S.A. 10-306 through 10-311.

    SECTION 4. Charter Ordinance No. 133 is hereby repealed.

    SECTION 5. This Charter Ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

    SECTION 6. This is a Charter Ordinance and will take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed and a referendum held on this ordinance as provided in Article 12, Section 5, Subdivision (c) of the Constitution of Kansas, in which case this Charter Ordinance shall become effective if approved by a majority of the electors voting thereon.

    PASSED BY THE CITY COUNCIL, not less than two-thirds of the members elect voting in favor thereof, the 21st day of February, 1995.
