  • A CHARTER ORDINANCE OF THE CITY OF WICHITA, KANSAS, PERTAINING TO THE SALARIES OF THE MAYOR AND CITY COUNCIL MEMBERS; AMENDING SECTIONS 1, 2, AND 3 OF CHARTER ORDINANCE NO. 179; AND REPEALING THE ORIGINAL SECTIONS THEREOF.

    WHEREAS, The City of Wichita, Kansas, by virtue of the power vested in by Article 12, Section 5 of the Constitution of the State of Kansas, has previously, by Charter Ordinance No. 43, elected to exempt itself and make inapplicable to it K.S.A. 12-1008, which section applies only to cities of the first class having a population of more than 150,000 and operating under the commission-manager form of government; and

    WHEREAS, the City of Wichita, Kansas now chooses to further amend its charter ordinance in order to provide for the salaries of the Mayor and City Council members.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. Section 2 of Charter Ordinance No. 43 of the City of Wichita, Kansas, as amended by Section 1 of Charter Ordinance No. 148 and Section 1 of Charter Ordinance No. 179, is hereby amended to read as follows:

    "From and after June 7, 2001, the total salaries and compensation, including the compensation established by Charter Ordinance No. 140, of the City Council members of the City of Wichita, currently set at $14,845, shall be increased $5,000.00 per year for 2001, 2002, and 2003, with an annual cost of living increase after 2003 equal to the increase in the consumer price index (CPIU or its equivalent) issued by the U.S. Department of Labor for the previous year, plus an automobile allowance as authorized by Council policy."

    SECTION 2. (Amended and repealed—See Charter Ordinance No. 188.)

    SECTION 3. Section 4 of the Charter Ordinance No. 43 of the City of Wichita, Kansas, as amended by Section 3 of Charter Ordinance No. 148 as amended by Section 3 of Charter Ordinance No. 179, is hereby amended to read as follows:

    "From and after June 7, 2001, the total salary and compensation, including the compensation established by Charter Ordinance No. 140, of the Vice-Mayor of the City of Wichita, currently set at $14,845, shall be increased $5,000.00 per year for 2001, 2002, and 2003, with an annual cost of living increase after 2003, equal to the increase in the consumer price index (CPI-U or its equivalent) issued by the U.S. Department of Labor for the previous year, plus an automobile allowance as authorized by Council policy."

    SECTION 4. Sections 1, 2 and 3 of Charter Ordinance No. 179 of the City of Wichita, Kansas are hereby repealed.

    SECTION 5. This Ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

    SECTION 6. This is a Charter Ordinance and will take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed and a referendum held on this ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of the State of Kansas, in which case this Charter Ordinance shall become effective if approved by a majority of the electors voting thereon.

    PASSED BY THE GOVERNING BODY, not less than two-thirds of the members elect voting in favor thereof, this 3rd day of April, 2001.
