  • A CHARTER ORDINANCE OF THE CITY OF WICHITA, KANSAS, PERTAINING TO THE SALARY OF THE MAYOR; AMENDING SECTION 2 OF CHARTER ORDINANCE NO. 187; AND REPEALING THE ORIGINAL SECTION THEREOF.

    WHEREAS, The City of Wichita, Kansas, by virtue of the power vested in by Article 12, Section 5 of the Constitution of the State of Kansas, has previously, by Charter Ordinance No. 43, elected to exempt itself and make inapplicable to it K.S.A. 12-1008, which section applies only to cities of the first class having a population of more than 150,000 and operating under the commission-manager form of government; and

    WHEREAS, the City of Wichita, Kansas now chooses to further amend its charter ordinance in order to provide for the salary of the Mayor.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. Section 3 of Charter Ordinance No. 43 of the City of Wichita, Kansas, as amended by Section 2 of Charter Ordinance No. 148, Section 2 of Charter Ordinance No. 179, and Section 2 of Charter Ordinance No. 187, is hereby amended to read as follows:

    "From and after August 9, 2001, the total salary and compensation, including the compensation established by Charter Ordinance No. 140, of the Mayor of the City of Wichita, currently set at $31,282, shall be increased to equal the average Sedgwick County Commissioner's salary as determined on August 9, 2001, with an annual cost of living increase, as of June 7, 2001, equal to the increase in the consumer price index (CPI-U or its equivalent) issued by the U.S. Department of Labor for the previous year, plus an automobile allowance as authorized by Council policy."

    SECTION 4. Section 2 of Charter Ordinance No. 187 of the City of Wichita, Kansas is hereby repealed.

    SECTION 5. This Ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

    SECTION 6. This is a Charter Ordinance and will take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed and a referendum held on this ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of the State of Kansas, in which case this Charter Ordinance shall become effective if approved by a majority of the electors voting thereon.

    PASSED BY THE GOVERNING BODY, not less than two-thirds of the members elect voting in favor thereof, this 5 day of June, 2001.
