  • A CHARTER ORDINANCE CHANGING THE TITLES OF THE GOVERNING BODY OF THE CITY OF WICHITA AND OF THE MEMBERS THEREOF AS USED IN K.S.A. 12-1001 to 12-1020, CHARTER ORDINANCES NOS. 43 AND 93, AND THE CODE OF THE CITY OF WICHITA.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. It is the intent of this Charter Ordinance to exempt the City of Wichita from only that part of the Commission-Manager form of government which establishes titles for the governing body and the members thereof, to provide substitute titles for the same, and to retain all other provisions of K.S.A. 12-1001 to 12-1020, Charter Ordinances Nos. 43 and 93, and the Code of the City of Wichita. The substitution of terms is not intended to make and does not connote any substantive change to existing enactments.

    SECTION 2. The City of Wichita, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself from certain titles and terms used in part of K.S.A. 12-1001 to K.S.A. 12-1020, inclusive, and to provide substitute and additional provisions as hereinafter set forth in this ordinance.

    SECTION 3. The term "council" is substituted for the term "board of commissioners" or "commission" wherever used for the governing body of the City of Wichita.

    SECTION 4. The term "council member" is substituted for the term "commissioner" wherever used for the members of the governing body of the City of Wichita.

    SECTION 5. All provisions of K.S.A. 12-1001 to 12-1020, Charter Ordinances Nos. 43 and 93, and the Code of the City of Wichita are hereby retained and remain in full force in this ordinance.

    SECTION 6. This Charter Ordinance shall be published once each week for two consecutive weeks in the official City newspaper.

    SECTION 7. This is a Charter Ordinance and shall take effect April 14, 1987, unless a sufficient petition for a referendum is filed requiring a referendum be held on the ordinance as provided in Article 12, Section 5, Subsection (c) (3) of the Constitution of the State of Kansas, in which case the ordinance shall become effective if approved by a majority of the electors voting thereon.

    PASSED BY THE GOVERNING BODY, not less than two-thirds of the members elect voting in favor thereof, this 6th day of January, 1987.
