  • A CHARTER ORDINANCE PERTAINING TO THE BOARD OF DIRECTORS AND OFFICERS OF CERTAIN CEMETERIES AND EXEMPTING THE CITY OF WICHITA FROM CERTAIN PROVISIONS OF K.S.A. 13-14c01, 13-14c03, AND 13-14c04, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS RELATING THERETO.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. The City of Wichita, Kansas, a city of the first class, by power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it, certain provisions of K.S.A. 13-14c01, 13-14c03, and 13-14c04 and provide substitute and additional provisions as hereinafter set forth in this Ordinance but to remain under all other provisions of said statutes not modified herein. Such referenced provisions are either enactments or a part thereof which are applicable to the City, but are not applicable uniformly to all cities.

    SECTION 2. The City Council shall constitute the Board of Directors and Trustees of any cemetery placed under the control of the City. The City Council shall succeed to all powers and authority over any cemetery previously placed in the Historic Wichita Board. The City Council shall have the duty to maintain and control the property and affairs of such cemetery and shall have the power to expend cemetery funds to maintain, care for, and improve such cemetery in accordance with K.S.A. 13-14c01 et seq. The authority for the City Council to act as said Board of Directors and Trustees is in addition to and supplemental to the provisions of K.S.A. 13-14c01.

    SECTION 3. The Board of Directors and Trustees shall have the same organization, officers, and terms as now or hereafter provided by law for the City Council and any provisions of K.S.A. 13-14c03 inconsistent with such organization, officers, and terms shall be inapplicable to the City.

    SECTION 4. It shall be the duty of the Director of Finance or such other officer as may be determined by the City Council to act as treasurer of the Board of Directors and Trustees, and any inconsistent provisions of K.S.A. 13-14c04 shall be inapplicable to the City.

    SECTION 5. This ordinance shall be published once each week for two consecutive weeks in the official City newspaper.

    SECTION 6. This is a Charter Ordinance and shall take effect sixty-one (61) days after final publication, unless a sufficient petition is filed and a referendum held on the ordinance as provided in Article 12, Section 5, Subsection (c)(3) of the Constitution of the State of Kansas, in which case the Ordinance shall become effective if approved by a majority of the electors voting thereon.
