  • A CHARTER ORDINANCE ESTABLISHING THAT CITY COUNCIL MEMBERS SHALL BE NOMINATED AND ELECTED FROM DISTRICTS, EXEMPTING THE CITY OF WICHITA, KANSAS, FROM K.S.A. 25-2110, 25-2110a, K.S.A. 12-1003, AND 12-1006 AND REPEALING CHARTER ORDINANCE NO. 93.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    It is the intent of this Charter Ordinance to exempt the City of Wichita, Kansas, from only those sections of the Commission-Manager form of government explicitly set out herein and to remain under all other provisions of K.S.A. 12-1001 through 12-1020, except when modified by other ordinances.

    The City of Wichita, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it the provisions of K.S.A. 25-1110, 25-1110a and K.S.A. 12-1003, and 12-1006 and provide substitute and additional provisions as follows:

    SECTION 1. Composition. Commencing with the election to be held in 1989, City Council members from districts I and III shall be nominated and elected from districts. Commencing with the election of 1991 City Council members from the remaining Districts shall be nominated and elected from districts. Each Council district shall be represented by one (1) Council member.

    SECTION 2. (Amended and repealed—See Charter Ordinance No. 226, §§ 6, 11.)

    SECTION 3. Qualifications. Each Council member shall be a citizen of the United States, a qualified elector, and a resident of the City of Wichita and their respective district at the time of filing for election and thereafter for the duration of their term.

    SECTION 4. (Amended and repealed—See Charter Ordinance No. 226, §§ 7, 11.)

    SECTION 5. (Repealed—See Charter Ordinance No. 226, § 11.)

    SECTION 6. (Amended and repealed—See Charter Ordinance No. 130, § 1.)

    SECTION 7. Council Districts. The initial districts from which district Council members I and III shall be nominated and elected in 1989 shall be those established by the commission of electors and adopted by ordinance by the City Council in accordance with Charter Ordinance No. 93. Commencing in 1991, districts from which council members shall be nominated and elected shall be those established in accordance with the provisions as set forth in this Charter Ordinance.

    SECTION 8. (Amended and repealed—See Charter Ordinance No. 173, § 1.)

    SECTION 9. (Amended and repealed—See Charter Ordinance No. 173, § 1.)

    SECTION 10. Repeal. Charter Ordinance No. 93 of the City of Wichita, Kansas, is hereby repealed.

    SECTION 11. Publication. This Charter Ordinance shall be published once each week for two consecutive weeks in the official City newspaper.

    SECTION 12. Election. This is a charter ordinance and is hereby made subject to a vote of the electors of the City of Wichita, Kansas. It shall take effect only if approved by a majority of the electors voting thereon.

    PASSED by the governing body, not less than two-thirds of the members elect voting in favor thereof, this 6th day of September, 1988.
