  • A CHARTER ORDINANCE PROVIDING FOR THE ELECTION OF A MAYOR BY ALL THE ELECTORS OF THE CITY OF WICHITA, KANSAS, EXEMPTING THE CITY OF WICHITA, KANSAS, FROM K.S.A. 12-1007 AND AMENDING CHARTER ORDINANCE NO. 93.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    It is the intent of this Charter Ordinance to exempt the City of Wichita, Kansas, from only those sections of the Commission-Manager form of government explicitly set out herein and to remain under all other provisions of K.S.A. 12-1001 through 12-1020, except where modified by other Charter Ordinances that are now in existence or may be enacted in the future.

    In addition to the exemption from state statute set forth in other Charter Ordinances now in existence or enacted in the future, the City of Wichita, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it the provisions of K.S.A. 12-1007.

    SECTION 1. Composition. Commencing with the election to be held in 1989, the Mayor shall be elected at large by all qualified electors of the City. The Mayor shall be an additional member of the governing body.

    SECTION 2. Mayor′s Powers and Duties. The powers and duties of the Mayor under this Charter Ordinance shall, except as modified herein, remain the same as presently set forth in simple ordinances, Charter Ordinances and state law unless such powers and duties are amended by City Council action.

    SECTION 3. Eligibility. Any person desiring to become a candidate for Mayor shall file with the City Clerk before the filing deadline a statement of such candidacy on a form furnished by the City Clerk. The City Clerk shall record the same and transmit it, together with the filing fee or petition, forthwith to the Sedgwick County Election Commissioner.

    Each such filing shall be accompanied by a filing fee of ten dollars ($10.00); or, in lieu of such filing fee, by a petition signed by one hundred (100) qualified electors of the City at large.

    SECTION 4. Qualifications. The Mayor shall be a citizen of the United States, a qualified elector, and a resident of the City of Wichita at the time of filing of election and thereafter for the duration of the term.

    SECTION 5. Election and Term. In the primary election, each qualified elector of the City of Wichita shall be entitled to vote for one (1) candidate for mayor. The two (2) mayor candidates receiving the greatest number of votes cast shall be placed on the general election ballot. See also Charter Ord. 208.

    SECTION 6. General Election. In the general election for Mayor all qualified electors of the City shall be entitled to vote for one candidate for Mayor. The candidate receiving the highest number of votes cast shall serve as Mayor.

    SECTION 7. (Amended and repealed—See Charter Ordinance No. 130, § 2.)

    SECTION 8. Amendment. Charter Ordinance No. 93 is hereby amended to delete reference to a five-member commission and provide for a governing body consisting of such members as is provided by this Charter Ordinance and other Charter Ordinances that are now in existence or may be enacted in the future.

    SECTION 9. Publication. This Charter Ordinance shall be published once each week for two consecutive weeks in the official City newspaper.

    SECTION 10. Election. This is a charter ordinance and is hereby made subject to a vote of the electors of the City of Wichita, Kansas. It shall take effect only if approved by a majority of the electors voting thereon.

    PASSED by the governing body, not less than two-thirds of the members elect voting in favor thereof, this 6th day of September, 1988.
