  • A CHARTER ORDINANCE ESTABLISHING A SIXTH CITY COUNCIL POSITION AND ESTABLISHING PROCEDURES FOR THE APPOINTMENT AND ELECTION OF A MEMBER TO SUCH POSITION AND AMENDING CERTAIN PROVISIONS OF CHARTER ORDINANCE NO. 112.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. Composition. Following the general election of 1989, the governing body shall consist of the Mayor and six (6) council members.

    SECTION 2. Initial Method of Selection. A sixth council position shall be created following the general election of 1989. Such position shall be at-large and the member shall be nominated and appointed by the governing body for a two (2) year term in accordance with the provisions set forth by ordinance for the filling of a council vacancy. Notice of such vacancy shall be deemed given at the first council meeting following the general election of 1989.

    SECTION 3. Term. After the initial two (2) year term, the sixth council position created by this ordinance shall be subject to nomination and election at the regular City elections in 1991 and for a two (2) year term and in 1993 and every four (4) years thereafter for a four (4) year term.

    SECTION 4. Qualifications. The sixth council member shall be a citizen of the United States, a qualified elector, and a resident of the City of Wichita at the time of appointment and thereafter for the duration of their term.

    SECTION 5. Revision for 1991 Election. As part of the process of revision of boundary lines as set forth in Charter Ordinance No. 112, the council shall take whatever action is necessary to determine whether the sixth council position shall be elected at-large or by district in 1991 and thereafter. In the event the Council does not take such action in a timely manner, the sixth Council position shall be elected by district in 1991 and thereafter.

    SECTION 6. Amendment of Charter Ordinance No. 112. If a sixth district is created by the process set forth in Section 5, all references in Charter Ordinance No. 112 to five (5) districts and one-fifth ( 1/5 ) of the population shall be amended and deemed to read six (6) districts and one-sixth ( 1/6 ) of the population accordingly.

    SECTION 7. Publication. This Charter Ordinance shall be published once each week for two consecutive weeks in the official City newspaper.

    SECTION 8. This is a Charter Ordinance and shall take effect sixty-one (61) days after final publication, unless a sufficient petition for a referendum is filed requiring a referendum to be held on the ordinance as provided in Article 12, section 5, subsection (c)(3) of the Constitution of the State of Kansas in which case the ordinance shall become effective if approved by a majority of the electors voting thereon.

    PASSED BY THE GOVERNING BODY, not less than two-thirds of the members elect voting in favor thereof, this 31st day of January, 1989.
