  • A CHARTER ORDINANCE OF THE CITY OF WICHITA, KANSAS, PERTAINING TO THE METHOD OF APPOINTMENT AND SIZE OF APPOINTIVE BOARDS AND COMMISSIONS; EXEMPTING THE CITY OF WICHITA FROM THE PROVISIONS OF K.S.A. 3-163 AND 3-165; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT RELATING TO AIRPORT AUTHORITIES, AND AMENDING SECTION 3 OF CHARTER ORDINANCE 56; SECTION 4 OF CHARTER ORDINANCE 62; SECTIONS 1, 2, 5, AND 6 OF CHARTER ORDINANCE 106; SECTION 1 OF CHARTER ORDINANCE 110, AND REPEALING THE ORIGINALS OF SAID SECTIONS.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. (Amended and repealed—See Charter Ordinance No. 137, § 1.)

    SECTION 2. (Amended and repealed—See Charter Ordinance No. 137, § 2.)

    SECTION 3. (Repealed by Charter Ordinance No. 166.)

    SECTION 4. Section 1 of Charter Ordinance 106 amending Section 2 of Charter Ordinance 30 of the City of Wichita, Kansas (pertaining to the Wichita Art Museum) is hereby amended to read as follows:

    "SECTION 2. The Art Museum Board shall consist of seven members appointed by the City Council of the City of Wichita, and such other ex officio members as shall be designated by ordinance. The official members of the said board shall be designated by the City Council of the City of Wichita. The members of such Art Museum Board shall be appointed and hold their offices for such terms as shall be established by ordinance. Ex officio members of the board shall have a voice, but no vote in the deliberations of the board. Vacancies on the board shall be filled for the unexpired term."

    SECTION 5. (Amended and repealed—See Charter Ordinance No. 125.)

    SECTION 6. (Repealed by Charter Ordinance No. 185.)

    SECTION 7. (Repealed by Charter Ordinance No. 185.)

    SECTION 8. Section 6 of Charter Ordinance 106 amending Section 2 of Charter Ordinance 72 of the City of Wichita, Kansas (pertaining to the Library Board) is hereby amended to read as follows:

    "SECTION 2. There is hereby authorized a Board to be known as ′The Board of Directors of the City of Wichita Library.′ The Board shall consist of fourteen members to be appointed by the City Council for such terms and subject to such limitations of terms as shall be designated by ordinance. All appointments made or to be made hereunder shall be made in accordance with the provisions of Chapter 2.12 of the Code of the City of Wichita, Kansas. Any member chosen to fill a vacancy occurring other than by expiration of term shall be for the unexpired term of the member whom he or she is to succeed."

    SECTION 9. Section 1 of Charter Ordinance 110 amending Section 8 of Charter Ordinance 106 of the City of Wichita, Kansas (pertaining to the Convention and Tourism Committee) is hereby amended to read as follows:

    "SECTION 12. The ′Convention and Tourism Committee′ shall continue as established to advise the City Council concerning the program and expenditures for convention and tourism.

    (a) The Committee shall consist of seven members appointed by the City Council. Members of the Committee will be appointed for such terms as shall be adopted by ordinance and will serve until their successors are appointed and qualified for office. Any vacancies in the membership of the Committee will be filled by the appointment of a member, as in the case of the original appointment, for the unexpired term of a member whose office shall be vacant.

    (b) The City Council shall ensure that in appointing members to said Committee, that there are members who shall be representatives from the hotel, motel and/or tourist court business.

    (c) In appointing members to said Committee, the City Council shall attempt to create a representative balance of large and small businesses and businesses from the various geographic areas of the city.

    (d) Any member of said Committee who shall leave the business from which he was appointed shall vacate his position and his successor shall be appointed by the City Council to fill the unexpired term.

    (e) Employees of the City of Wichita, Kansas, or for purposes of this ordinance only, members of other boards or commissions of the City may be appointed to said Committee.

    (f) The Convention and Tourism Committee shall adopt rules and bylaws in accordance and compliance with the standard bylaws of the City of Wichita, Kansas, which shall become effective when approved by the City Council.

    (g) Said Committee shall elect from its members a president and two (2) vice-presidents for a term of one year each. Specific duties and responsibilities of these officers shall be stipulated in the bylaws of the Committee.

    (h) Said Committee shall hold regular meetings at a time and place as established in the bylaws adopted by the Committee, all subject to the approval of the City Council as provided in subsection (f) above. All regular meetings shall be open to the public.

    (i) The City Manager at the request of the City Council shall make available whatever clerical or secretarial personnel may be required by said Committee.

    (j) No member of the Conventional and Tourism Committee shall receive any compensation whatsoever for his or her services.

    (k) The governing body of the City of Wichita, Kansas, upon adoption of said transient guest tax, shall have the authority to contract for convention and tourism programs to be implemented.

    SECTION 10. The Originals of Section 3 of CHARTER ORDINANCE 56, Section 4 of CHARTER ORDINANCE 62, Sections 1, 2, 5, and 6 of CHARTER ORDINANCE 106, and Section 1 of CHARTER ORDINANCE 110 of the Code of the City of Wichita, Kansas, are hereby repealed.

    SECTION 11. This ordinance shall be published once each week for two consecutive weeks in the official City paper.

    SECTION 12. This is a charter ordinance and shall take effect sixty-one days after final publication unless a sufficient petition for referendum is filed and a referendum held on the ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of the State of Kansas, in which case, the ordinance shall become effective if approved by a majority of the electors voting thereon.
