  • A CHARTER ORDINANCE EXEMPTING THE CITY OF WICHITA, KANSAS FROM A PART OF K.S.A. 13-1348a AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT; RELATING TO ELECTIONS ON THE QUESTION OF ISSUING GENERAL OBLIGATION BONDS FOR THE PURPOSE OF PURCHASING LAND FOR PARK, PARKWAY, BOULEVARD OR AIRPORT PURPOSES OR FOR THE CONSTRUCTION, ENLARGEMENT, RECONSTRUCTION, REPAIR OR ADDITION TO OR OF ANY IMPROVEMENTS TO ANY SUCH LANDS FOR ANY SUCH PURPOSES OR ANY SUCH LANDS AND ANY SUCH IMPROVEMENTS.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. That the City of Wichita, Kansas by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and exempts itself from and makes inapplicable to it that part of K.S.A. 13-1348a which limits elections on bond issues to a general or regular City election, which statute applies only to cities having a Board of Park Commissioners, created under K.S.A. 13-1346 and to provide substitute and additional provisions as hereinafter provided.

    SECTION 2. That the question of the issuance of bonds as authorized by 13-1348a may be submitted to a vote of the qualified electors of the City of Wichita, Kansas at a general or regular city election and also at a special bond election called for that purpose.

    SECTION 3. This ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

    SECTION 4. This is a Charter Ordinance, and shall take effect sixty-one (61) days after final publication, unless a sufficient petition for a referendum is filed requiring a referendum be held on the ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of Kansas, in which case the ordinance shall become effective if approved by a majority of the electors voting thereon.

    PASSED BY THE GOVERNING BODY, not less than two-thirds of the members elect voting in favor thereof, the 24th day of October, 1967.
