  • A CHARTER ORDINANCE EXEMPTING THE CITY OF WICHITA, KANSAS, FROM K.S.A. 13-1802; AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT RELATING TO MEMBERS OF THE BOARD OF CITY COMMISSIONERS HOLDING OFFICES OTHER THAN WITH THE CITY OF WICHITA.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. That the City of Wichita, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and exempts itself from and makes inapplicable to it that part of K.S.A. 13-1802, which limits offices that may be held by the Mayor and City Commissioners and to provide substitute and additional provisions, as hereinafter provided.

    SECTION 2. That no member of the Board of Commissioners, or the Mayor, shall hold any office of profit or trust under the laws of any state or the United States, or hold any county or other city office; nor shall the Mayor or any Commissioner ever be elected or appointed to any office, the compensation of which was increased or fixed by the Board of Commissioners, while he was a member thereof, until after the expiration of at least two years after he has ceased to be a member of said board; PROVIDED, that nothing herein contained shall limit the appointment of the Mayor or any Commissioner without compensation to any board of the City of Wichita during their respective terms of office.

    SECTION 3. This ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

    SECTION 4. This is a Charter Ordinance, and shall take effect sixty-one (61) days after final publication, unless a sufficient petition for a referendum is filed requiring a referendum be held on the ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of Kansas, in which case the ordinance shall become effective if approved by a majority of the electors voting thereon.

    PASSED BY THE GOVERNING BODY, not less than two-thirds of the members elect voting in favor thereof, this 7th day of November, 1967.
