  • A CHARTER ORDINANCE REPEALING CHARTER ORDINANCES NOS. 56, 65, 70, 82, SECTION 3 OF CHARTER ORDINANCE NO. 106, AND SECTION 3 OF CHARTER ORDINANCE NO. 119 ALL PERTAINING TO THE WICHITA METROPOLITAN TRANSIT AUTHORITY.

    WHEREAS, under the authority of Article 12, Section 5, of the Constitution of the State of Kansas the City of Wichita, Kansas, has previously exempted itself from the provisions of K.S.A. 13-3103, 13-3104 and 13-3106 which pertain to the operation of transit systems by cities of the first class; and

    WHEREAS, the City of Wichita has previously operated such a transit system by a transit authority created by charter ordinance; and

    WHEREAS, the City of Wichita now wishes to assume operation of the transit system directly as a part of its municipal operations as provided for in K.S.A. 13-3101 through 13-3116 and Article 12, Section 5, of the Constitution of the State of Kansas.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. The originals of Charter Ordinances Nos. 56, 65, 70, 82, Section 3 of Charter Ordinance No. 106, and Section 3 of Charter Ordinance No. 119 are hereby repealed.

    SECTION 2. This ordinance shall be published once each week for two consecutive weeks in the official city paper.

    SECTION 3. This is a Charter Ordinance and shall take effect sixty-one (61) days after final publication unless a sufficient petition for referendum is filed requiring a referendum to held on the ordinance as provided in Article 12, Section 5, Subsection (c)(3) of the Constitution of the State of Kansas, in which case the ordinance shall become effective if approved by a majority of electors voting thereon.

    PASSED AND APPROVED by the governing body, not less than two-thirds of the members voting in favor thereof, this April 1, 1997.
