  • A CHARTER ORDINANCE EXEMPTING THE CITY OF WICHITA, KANSAS FROM CERTAIN PROVISIONS OF K.S.A. 1977 SUPPLEMENT 41-719 AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS WHICH RELATE TO THE CONSUMPTION OF ALCOHOLIC LIQUOR UPON PROPERTY LEASED BY THE CITY UNDER THE PROVISIONS OF THE INDUSTRIAL REVENUE BOND ACT.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. That the governing body of the City of Wichita, Kansas, by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to and exempts itself from and makes inapplicable to it that part of K.S.A. 1977 Supplement 41-719, pertaining to the consumption of alcoholic liquor upon property leased by a city under the provisions of K.S.A. 12-1740 to 12-1749, inclusive and any amendments thereto, as follows:

    "Provided, however, the limitations, aforesaid, shall not apply to real property leased by a city to others under the provisions of K.S.A. 12-1740 and 12-1749, both sections inclusive, and any amendments thereto, if such real property is actually being used for hotel or motel purposes or purposes incidental thereto …"

    and hereby providing substitute and additional provisions as hereinafter set forth.

    SECTION 2. That the limitations of K.S.A. 1977 Supplement 41-719, pertaining to the consumption of alcoholic liquor in public places, shall not apply to any real property leased by the City of Wichita, Kansas, to others under the provisions of K.S.A. 12-1740 to 12-1749, both sections inclusive, and any amendments thereto, notwithstanding the purpose of which such real property is actually being used. That said K.S.A. 1977 Supplement 41-719 shall continue to be applicable to the City of Wichita, Kansas, except only as provided for herein.

    SECTION 3. That this ordinance shall be published once each week for two consecutive weeks in the official City newspaper.

    SECTION 4. That this is a charter ordinance and shall take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed, and a referendum held on this ordinance as provided in Article 12, Section 5, Subdivision (c)(3) of the Constitution of Kansas, in which case the ordinance shall become effective if approved by a majority of the electors voting thereon.

    PASSED BY THE BOARD OF CITY COMMISSIONERS, not less than two-thirds of the members elect voting in favor thereof, this 12th day of September, 1978.
