  • A CHARTER ORDINANCE EXEMPTING THE CITY OF WICHITA, KANSAS, FROM CERTAIN PROVISIONS OF SECTION 76-3a07, KANSAS STATUTES ANNOTATED, AND PROVIDING A SUBSTITUTE LEVY, COMMENCING WITH BUDGET YEAR 1967.

    BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WICHITA, KANSAS:

    SECTION 1. That the governing body of the City of Wichita, Kansas, by the power vested in it by Article 12, Section 5, of the constitution of the state of Kansas, hereby elects to and exempts itself from and makes inapplicable to it that part of Section 76-3a07, Kansas Statutes Annotated, pertaining to the levying of a ax as follows:

    "… the governing body of the city of Wichita shall levy an annual tax commencing with the budget year of 1967 at the rate of one and one-half mills on the dollar on all taxable tangible property in such city.",

    which section applies only to the City of Wichita, and hereby provides a substitute provision as hereinafter set forth.

    SECTION 2. That the City of Wichita shall levy an annual tax commencing with the budget year 1967 at the rate of one and one-half (1 ½) mills on the dollar on all the taxable tangible property in such city, the amount of such tangible, taxable property to be calculated each year on the basis of the equalized assessed valuation determined by the County Assessor of Sedgwick County, Kansas for the preceding year, such levy to be employed in the manner and for the purposes prescribed by said Section 76-3a07, Kansas Statutes Annotated. That said Section 76-3a07, Kansas Statutes Annotated, shall continue to be applicable to the City of Wichita except only as provided for herein.

    SECTION 3. That this ordinance shall be published once each week for two consecutive weeks in the official city newspaper.

    SECTION 4. That this is a charter ordinance and shall take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed and a referendum held on this ordinance as provided in Article 12, Section 5, Subdivision (c) (3) of the Constitution of Kansas, in which case the ordinance shall become effective if approved by a majority of the electors voting thereon.

    Passed by the Board of Commissioners, not less than two-thirds of the members-elect voting in favor thereof, this 1st day of March, 1966.
