§ 11.16.040. Police officer—Duties generally.

  • (a)

    Police officers of the city shall at all times be empowered to enforce the provisions of this and other traffic ordinances of this city and temporary and emergency rules and regulations of the chief of police, and may at any time direct and control traffic in person or by visible or audible signals: Provided, that any officer actively directing traffic in the event of a fire, temporary traffic congestion or other emergency, or to expedite the flow of traffic or to safeguard pedestrians, may by proper signal cause any vehicle or pedestrian to stop at or pass through any intersection whether the same be controlled by an official traffic-control sign or light, or to disregard a sign otherwise provided by ordinance.

    (b)

    The Chief of Police shall have the authority to designate special officers to enforce parking violations, The authority to designate such special officers is limited to city employees appointed to the Police Department by the City Manager. Such officers shall only have the enforcement authority to issue citations for violations of parking ordinances found in this chapter. The special officers so designated will issue parking citations only under the direction and supervision of the Chief of Police.

    (c)

    Whenever any motor vehicle is parked in violation of any of the provisions of this title, a summons consisting of a notice of violation with the following information:

    (1)

    The state license number of the vehicle in violation;

    (2)

    The time at which such vehicle was in violation;

    (3)

    The location, by the nearest street address, of the vehicle in violation, or the number of the parking meter indicating that the motor vehicle occupying the parking space adjacent to such parking meter is or has been parking in violations; and

    (4)

    Other facts which are necessary to a thorough understanding of the circumstances attending such violation including, if known, the length of time the motor vehicle was parked in violation, shall be attached to every vehicle violating any kind of parking provisions of this title instructing such owner or operator to answer the charges of said violation before the municipal court of the city.
