§ 11.38.355. Operation of all-terrain vehicles; where; when; exceptions.

  • (a)

    Except as provided in subsection (b), it shall be unlawful for any person to operate an all-terrain vehicle on any street or highway within the city limits.

    (b)

    Notwithstanding the provisions of subsection (a), all-terrain vehicles may be operated on streets and highways:

    1.

    If the all-terrain vehicle is owned and operated by a county department, or owned and operated by persons contracting with a county noxious weed department or the Kansas Department of Transportation; or

    2.

    if the all-terrain vehicle is used by the Wichita Police Department or another department within the City of Wichita for official business; or

    3.

    in accordance with Section 3.11.205 of the code of the City of Wichita.

    (c)

    No all-terrain vehicle shall be operated on any public highway, street or road between sunset and sunrise unless equipped with lights as required by law for motorcycles.
