§ 18.40.210. Serving and filing of notices.

  • (a)

    The serving and filing of notices and orders and the filing of affidavits pursuant to this section shall be as follows:

    (1)

    Notices and orders shall be served upon all persons entitled thereto, either personally or by certified mail, but if the whereabouts of such persons is unknown and the same cannot be ascertained in the exercise of reasonable diligence, an affidavit shall be made to that effect;

    (2)

    Serving of such notice and order upon such persons shall be made by publishing the same once each week for two consecutive weeks in the official city newspaper.

    (b)

    In the event the final order is not complied with then:

    (1)

    A copy of such notice and order shall be posted in a conspicuous place on the premises affected by the complaint and order;

    (2)

    A copy of such notice, order, affidavit and publications shall also be filed with the clerk of the district court of Sedgwick County, Kansas, and such filing of the notice and order shall have the same force and effect as other lis pendens notices provided by law.
