§ 2.12.020. Organizational structure of appointive boards and commissions.

  • The following rules and regulations shall govern the organizational structure of appointive boards and commissions of the city:

    (1)

    As used in this ordinance, the term "appointive boards and commissions" includes but is not limited to the following

    Animal Control Advisory Board

    3.

    Board of Code Standards and Appeals

    4.

    Board of Electrical Appeals

    5.

    Bicycle and Pedestrian Advisory Board

    6.

    Board of Park Commissioners

    7.

    Wichita Board of Zoning Appeals

    8.

    Community Services Block Grant Review Committee

    9.

    District Advisory Boards for Districts 1, 2, 3, 4, 5 and 6

    10.

    Design Council

    11.

    Wichita Employees Retirement System Board of Trustees

    12.

    Historic Preservation Board

    13.

    Sedgwick County Juvenile Corrections Board

    14.

    Library Board

    15.

    Metropolitan Area Planning Commission

    16.

    Public Building Commission

    17.

    Police and Fire Retirement Board

    18.

    Plumbers and Gas Fitters Board of Appeals

    19.

    Sedgwick County Community Corrections Advisory Board

    20.

    Self-Supported Municipal Improvement District Advisory Board

    21.

    Storm Water Advisory Board

    22.

    Transit Advisory Board

    23.

    Tourism Business Improvement District Board

    This term shall not include temporary or ad hoc committees established by the City Council or City Manager.

    (2)

    All appointments to boards and commissions shall expire March 31, 2018 whether made before or after the effective date of the ordinance codified in this section, and thereafter all terms shall commence April 1st and expire on March 31 st . The terms for board members set to expire prior to March 31st shall be extended until March 31, 2018. Except as set forth below, the maximum term of all members shall be not more than two years or until a successor has been duly appointed and qualified. A vacancy shall be filled for the unexpired term of a member in the same manner as an original appointment.

    (3)

    The minimum number of members of any board or commission shall be five members.

    (4)

    The minimum number of officers of any board or commission shall be not less than three officers to be known as a president and two vice-presidents notwithstanding any other provision of this Code to the contrary, and such other officers as such board itself may deem necessary, all officers to be elected by the members of the board for a maximum term of not to exceed one year, and for a maximum tenure of office not to exceed two consecutive terms.

    (5)

    A regular schedule of meetings shall be established by each board or commission, with appropriate notice to the public, and with a minimum schedule providing for meetings to be held not less than once each month and more often as the work load requires, and with the appropriate provisions that meetings may be called by any one of the principal officers (president or vice-presidents) or by any majority of the members.

    (6)

    The members of each board or commission shall be appointed from the broadest possible base of the community at large, and not from any specific organization or group except as may be otherwise provided for advisory boards.

    (7)

    A regular full-time city employee shall be assigned as ex officio secretary to each board and commission for purposes of maintaining records, minutes and the handling of administrative matters without the right to vote or to perform any other function than provide administrative services.

    (8)

    Any member of a board or commission shall be removed from office by the City Council after due notice and hearing for nonattendance at three consecutive meetings, or for absence of more than fifty percent of the meetings held during any twelve-month period of time. A meeting canceled for lack of a quorum is considered a meeting for purposes of recording attendance. The ex officio secretary will provide written notice to the non-attending board or commission member and the City Manager. A vacancy shall be declared unless the board member requests a hearing before the City Council within ten days after notice is provided.

    (9)

    Each member of any board or commission shall disclose any conflict of interest as may arise in connection with matters being considered by the board or commission of which he is a member, and shall refrain from discussing or voting on any such matters.

    (10)

    The City Council shall reserve the right to review all decisions of subsidiary boards and commissions except as may otherwise be provided by law, in order that aggrieved citizens may have the right of appeal to an elected body from the decision of an appointive body of the city.

    (11)

    All appointments shall be made to city boards and commissions by written notice of appointment, which notice shall clearly state that such appointment is made subject to all the provisions outline herein, the term of the appointment, and that members so appointed may be removed by the City Council for violation of any of the rules and regulations hereby established.
