§ 2.12.390. Same—Planning area jurisdiction.

  • The area of planning jurisdiction for comprehensive planning, as may be defined by statute or further agreement between the cooperating agencies, shall include all of Sedgwick County and such other areas which, in the opinion of the commission, bear a direct relationship to the development of the area. The planning commission shall hold hearings on all zoning matters within the City of Wichita and within the unincorporated area three miles from the City of Wichita or from any city becoming a member of the metropolitan area planning commission; or for such area as may be determined appropriate if zoning is established under the provisions of K.S.A. 1965 Supp. 19-2919, et seq. The planning commission shall have subdivision jurisdiction within the City of Wichita and the unincorporated area within three miles thereof, and/or such other unincorporated area as may be determined appropriate by the board of county commissioners of Sedgwick County, either by resolution of that board or by concurrence with subdivision regulations adopted by the planning commission. The planning commission shall also have such other jurisdiction as may be possessed by any member governing body or their planning commission when expressly delegated to the Wichita-Sedgwick County metropolitan area planning commission by resolution or ordinance. All matters pertaining to planning, zoning or subdivision affecting land within three miles of any member city or county shall be referred to the local planning commission, if there be one, for discussion and recommendation before said matter shall be considered before the metropolitan area planning commission for action.
