§ 3.14.085. Appeal to City Council.

  • (a)

    In the event that an applicant or a permit holder desires to appeal the decision of the City Manager regarding the denial or revocation of a permit to the City Council, written notice of such appeal shall be filed with the City Clerk within ten business days of the date upon the City Manager's written decision. Any appeal taken from the decision of the City Manager shall stay the Manager's order until the matter is heard and a decision rendered by the City Council.

    (b)

    The City Clerk shall schedule a hearing before the City Council at its next regularly scheduled meeting, which shall occur no later than thirty days from the date of the filing of the Notice of Appeal with the City Clerk.

    (c)

    The City Council may approve the denial or revocation, overrule the denial or revocation or modify the decision of the City Manager.

    (d)

    The Council's decision may be appealed to the Eighteenth Judicial District Court of Kansas pursuant to K.S.A. 60-201, et seq., and any amendments thereto. Any such appeal to the District Court shall not stay the order by the City Council.
