§ 5.68.140. Lewd and lascivious behavior.

  • Lewd and lascivious behavior is:

    (a)

    Publicly engaging in otherwise lawful sexual intercourse or sodomy with any person or animal with knowledge or reasonable anticipation that the participants are being viewed by others who are 16 or more years of age; or

    (b)

    Publicly exposing a sex organ or exposing a sex organ in the presence of a person who is 16 or more years of age, is not the spouse of the offender and who has not consented thereto, with intent to arouse or gratify the sexual desires of the offender or another.

    Any person committing lewd and lascivious behavior shall be deemed guilty of a misdemeanor, and any person convicted thereof shall be punished by a fine of not more than $500.00 or six months; imprisonment, or both such fine and imprisonment.
