§ 12.04.065. Abandonment of tracks—Removal required.

  • (a)

    Railway companies, upon abandonment of use of railroad tracks located in streets, alleys and other public ways within the corporate limits of the city of Wichita, shall remove such railroad tracks and shall upon the removal of such railroad tracks repair the street, alley or other public way the railroad tracks are removed from to a condition that is equal to or better than the street, alley or other public way that is located on either side of the railroad track.

    (b)

    The presence of railroad tracks in a street, alley or other public way after a railway company has abandoned the use of the railroad tracks is declared to be a public nuisance and the city attorney shall be authorized to bring appropriate legal action in the District Court of Sedgwick County, Kansas, to cause such railroad tracks to be removed and to take whatever other action is deemed to be appropriate.
