§ 12.04.060. Penalty.

Any railroad company, after it has been served with notice in writing as provided in Section 12.04.055 to construct or maintain suitable grade crossings in compliance with 12.04.010 over its tracks at a public grade crossing and has failed, neglected or refused to commence the same within the space of ninety days after the service of such notice upon it, or thereafter fails, neglects or refuses to complete the same within one hundred eighty days after service of such notice upon it, shall, upon conviction thereof, be guilty of a misdemeanor. Each day that any violation of this chapter continues shall constitute a separate offense and shall be punishable as a separate violation.
