§ 14.04.040. Conditions for qualification.

  • An industry shall be a qualified industry only when and so long as each of the following conditions is complied with to the reasonable satisfaction of the central inspection superintendent:

    A.

    The industry's technical activities shall be covered by valid public liability insurance, written by a company (or companies) authorized to do business in the State of Kansas, with limits of not less than fifty thousand dollars for injury or death of any person, of not less than one hundred thousand dollars for property damage in any one occurrence, and of not less than three hundred thousand dollars in aggregate limits for any one occurrence.

    B.

    The industry shall either:

    1.

    have its technical activities covered by casualty insurance written by a company or companies which require compliance with national underwriting codes and which, to the satisfaction of the central inspection superintendent, enforce such compliance through inspections, which inspections are evidenced by written reports supplied to the industry, with reference to which the industry agrees (a) to file copies of such reports with the central inspection superintendent within ten days after their receipt by the industry, and (b) to comply with the requirements of such reports except as to any particular item which the central inspection superintendent finds to be unnecessary for compliance with acceptable standards; or

    2.

    conduct its technical activities under the supervision of a licensed professional engineer who is a full time employee (or partner or owner) of the industry, or cause its technical activities to be checked periodically by an independent licensed professional engineer, qualified in the particular fields of such activities and licensed under the statutes of the State of Kansas as amended, who shall be responsible for certifying that such technical activities are being conducted in accordance with acceptable standards; or

    3.

    cause its technical activities to be controlled by a full time employee (or partner or owner) who shall satisfy the respective board of examiners that he is reasonably capable by training and experience of interpreting and applying acceptable standards to the extent that the same are applicable to the operations of the particular industry. There shall be on file with the central inspection superintendent at all times the name of such person, his residence address, and a statement signed by him setting forth in reasonable detail his qualifications and experience for said duties. If an industry uses separate individuals to supervise separate portions of the activities otherwise covered by the technical codes, separate statements shall be filed by each of the said supervising personnel.

    C.

    The industry shall be the holder of a current industrial compliance certificate issued pursuant to Section 14.04.050 hereof.
