§ 18.40.010. Definitions.

  • As used in this chapter:

    "Accessory structure" means a structure the use of which is incidental to that of the main building and which is attached thereto or located on the same premises.

    "Building" means a structure adapted to permanent or continuous occupancy or use for public, institutional, business, industrial or storage purposes.

    "Building manager" means any person who manages or owns a building and may be either agent for or owner of a building.

    "Building occupant" means any person who leases, rents or owns a building or portion thereof and who physically occupies or has possession of a building or portion thereof.

    "Fire hazard" shall be defined as follows:

    (a)

    Any device or condition likely to cause fire and which is so situated as to endanger either persons or property;

    (b)

    The creation, maintenance, or continuance of any physical condition by reason of which there exists a use, accumulation or storage of combustible or explosive material sufficient in amount or so located or in such a manner as to put in jeopardy in event of ignition, either person or property;

    (c)

    The obstruction to or of fire escapes, ladders which may be used as escape, stairways, aisles, exits, doors, windows, passageways or halls likely in the event of fire to interfere with the operations of the fire department or of the safety and ready egress of occupants.

    "Infestation" means the presence of insects, rodents, vermin or other pests on the premises which constitute a health hazard.

    "Notice" means a written report issued to the owner and/or his agent by the superintendent of central inspection or his designated representative stating in detail the improvements and/or corrections required to be accomplished on a premises or building which will bring such into compliance with this Code.

    "Order" means a directive issued to the owner and/or his agent by the superintendent of central inspection or the board of code standards and appeals after such hearings as required by this Code stating that the owner shall make improvements and/or corrections to a premises or building to bring such into compliance with this Code or to remove the building and clear the premises.

    "Owner" means a person who alone or jointly or severally with others:

    (a)

    Shall have record legal title to any property or structure thereon with or without accompanying actual possession thereof, or

    (b)

    Shall have charge, care or control of any property or structure thereon as owner or as executor, executrix, administrator, administratrix, trustee, or guardian of the estate of the owner.

    "Person" means a natural person or a legal entity such as, but not limited to, an individual, firm, association, joint stock company, syndicate, partnership or corporation.

    "Premises" means a lot, plot or parcel of land including structures located thereon.

    "Structure" means that which is built or constructed, an edifice or building of any kind or any piece of work artificially built up or composed of parts joined together in some definite manner.
