§ 18.40.020. Short title—Purpose.

  • This chapter shall be known as the "Premises Maintenance Standards for Existing Buildings."

    Every portion of a building or premises shall comply with the provisions of this chapter. The chapter provides for minimum standards for the continued use and occupancy of all buildings and does not replace standards under which a structure was constructed and equipped. Repair and alterations shall be approved providing such work results in a general improved condition of the structure and does not diminish the safety of the structure or occupants.

    The purpose of this chapter is to protect the public health, safety of the citizens of the city, by establishing minimum standards governing the maintenance of all structures and premises; fixing certain responsibilities and duties of owners, agents, and occupants of all structures unfit for human use, occupancy, and habitation, and fixing penalties for the violation of the provisions of this chapter. This chapter is declared to be remedial and essential to the public interest, and it is intended that this chapter be liberally construed to serve the purposes as stated above; provided, however, that the intent of this chapter shall, in addition, be to assist and further the restoration and preservation of those sites, buildings, structures and objects which have been entered or may be eligible for entry on the National Register of Historic Places, pursuant to Title 16, United States Code. Section 470(a) or other appropriate legislation, or as designated by the Historic Wichita Board or the Kansas Historical Society, and those sites, buildings and structures which contribute to the integrity of location, design, setting, feeling and association of any such designated or eligible historic place, it being recognized that such structures cannot and will not be restored and preserved if they are required to conform to building codes and other regulations promulgated subsequent to their construction, and it is further intended that this chapter be liberally construed to serve the purposes as stated above and to further such restoration and preservation.
