  • (a)

    The board shall administer the fund, which shall consist of contributions for Plan No. 1, Plan No. 2 and Plan No. 3. The Wichita employees' retirement board shall consist of sixteen members, as follows:

    (1)

    The city manager, or the city manager's designee;

    (2)

    One employee to be appointed by the city manager;

    (3)

    Seven members appointed by the city council, who need not be employees of the city; and

    (4)

    Seven employees of the city to be elected at-large by all employees of the city.

    (b)

    Terms of members of the Wichita employees' retirement board are as follows:

    (1)

    For those members appointed by the city council, the terms of office shall be as set forth in Section 2.12.020(1);

    (2)

    For those members elected at-large by employees eligible for benefits under the city employees' retirement plans, those terms shall be for four years;

    (3)

    For the member appointed by the city manager, the member so appointed shall be for a two-year term ending on August 31st of the second year following such appointment. The city manager's designee shall serve for a two-year term and end on August 31st in the year after the term of the city manager's appointed member.

    (c)

    Administration.

    (1)

    Any elected or appointed member of the board shall be removed from the board after due notice and hearing for nonattendance at three consecutive meetings or for absence of more than fifty percent of the meetings held during any twelve-month period of time. A meeting canceled for lack of a quorum is considered a meeting for purposes of recording attendance. The pension manager will provide written notice to the non-attending board member and the city manager. A vacancy shall be declared unless the board member requests a hearing within ten days after notice is provided. In the case of a board member appointed by the city council, any hearing shall be conducted and determined by the city council. In the case of a board member elected at-large by employees, any hearing shall be conducted by the board at its next regular meeting, and a majority vote will be necessary to reinstate such board member. In the case of a board member appointed by the city manager, any hearing shall be conducted and determined by the city manager;

    (2)

    In the case of a vacancy in the board membership appointed by the city council, the city council shall immediately appoint another member to serve the balance of such term. In the case of a vacancy in any of the seven employee representatives, employees eligible to vote for such membership shall immediately elect a successor, except that in the case of a vacancy in the employee member position appointed by the city manager, the successor of such employee member position shall be an employee appointed by the city manager;

    (3)

    In the case of a vacancy in the administrative office of the city manager, the person designated as the acting official shall immediately take office only until the appointment and qualification of a permanent successor;

    (4)

    The president and vice-presidents of the board shall be elected by members of the board. The city manager shall appoint an employee to serve as executive secretary of the board and keep such records and minutes as the city manager and the board may prescribe. The city treasurer, ex officio, is designated as the custodian of the fund and shall post such additional bond as the board may deem necessary;

    (5)

    The board shall meet once a month on the third Wednesday, and shall meet more or less often as determined by the president or executive secretary;

    (6)

    The board is authorized and directed to establish and maintain proper accounts necessary to give effect to this chapter, in accordance with generally accepted accounting principles as issued by the governmental accounting standards board. The board shall adopt and file with the city clerk rules and regulations for the administration of this chapter, and for the direction and supervision of the fund consistent with the provisions thereof;

    (7)

    The board shall make recommendations to the city council as to sources of funds for meeting the city's share of the cost of the fund and as to probable cost of the system as between employees under the jurisdiction of the city manager, the library board and the art museum;

    (8)

    All expense incurred by the board shall be paid from the fund; and

    (9)

    The board may also recommend to the city council any changes or amendments to this chapter.
