§ 7.22.050. Suspension of permit.

  • (a)

    The regulatory authority may, upon ten days' written notice to the person holding a permit to operate a food establishment, suspend such permit for up to ten days, or until the violation ceases to exist, for any violation of the provisions of this chapter, which violation does not in his judgment justify revocation of the permit; provided, however, that the permit holder may appeal such suspension by filing a written request for a hearing with the regulatory authority within ten days of the date on the notice. Upon receipt of such request for a hearing, the regulatory authority shall schedule a hearing to be held not more than ten days from the date of receipt of the request and shall notify the permit holder of the date and location of the hearing in writing.

    (b)

    The regulatory authority may, upon written order, without warning, prior notice, or hearing, suspend any permit to operate a food establishment or temporary food establishment if the operation of the food establishment or temporary food establishment constitutes an immediate hazard to the public health, such as an extended loss of water supply, an extended power outage, or sewer backup into the establishment; or when gross unsanitary conditions exist. When such permit is suspended, operations shall be suspended immediately. In instances of suspension prior to the opportunity for a hearing, the regulatory authority shall proceed as quickly as feasible to conduct hearing proceedings.
