§ 7.60.080. Penalty.

(a)

Any person convicted of violating the provisions of Section 7.60.040 (b)shall be guilty of a tobacco infraction and upon conviction shall be fined $55 for a first offense; $100 for a second offense, and $150 for a third or subsequent offense. A request to the appropriate court may be made that consideration be given to community service for the offender as an alternative to any set fine.

(b)

Any person convicted of violating the provisions of this chapter other than 7.60.040(b) shall be guilty of a misdemeanor.

Ord. No. 50-602, § 8, adopted Oct. 17, 2017, repealed the former § 7.60.080 and enacted a new § 7.60.080 as set out herein. The former § 7.60.080 pertained to penalty for violation of the provisions of the chapter and derived from Ord. No. 42-423 § 8.
