§ 14.04.020. Definitions.

  • For the purposes of this chapter, the following definitions shall apply:

    The term TECHNICAL CODES shall refer to Chapters 15.12 and 16.08 and to Titles 18, 19, 21 and 22 of the Code of the City of Wichita which chapters and titles are commonly known respectively as the flammable liquids code, the drain layer's code, the building code, the electrical code, the plumbing and gas fitting code, and the air conditioning refrigeration and warm air heating code; and such terms shall include all amendments thereto.

    The word INDUSTRY shall include every corporation, firm, and partnership which carries on a business within the city which is

    (1)

    a public utility operating under a franchise or certificate of convenience and necessity from the city for the supplying of water, gas, steam, electricity, telephone service, or the transportation of passengers,

    (2)

    a railroad operating under the control of the Interstate Commerce Commission, or

    (3)

    a business included in the use regulations for the "E" light industrial district or the "F" heavy industrial district under Chapter 28.04 of the Code of the City of Wichita, as amended from time to time exclusive, however, of any business of a type included in such use regulations by reason of its being authorized under the use regulations pertaining to any other of the districts described in said Chapter 28.04.

    The term QUALIFIED INDUSTRY shall mean any industry that has qualified under Section 14.04.040 hereof for self regulation of those activities and installations that would otherwise be subject to the technical codes.

    The term TECHNICAL ACTIVITIES shall mean the doing of any work by the industry itself or under contract, or the use or installation of any materials, parts, or equipment which, except for the provisions of this chapter, would be subject to regulation of the city under one or more of the technical codes, and which is for the use of the industry itself in carrying on some other occupation.

    The term ACCEPTABLE STANDARDS shall mean, as applied to any particular industry, any standards of materials or of performance contained in any of the following publications which are reasonably applicable to the technical activities of a particular industry's business operations: (1) those standards described and required by the National Building Code, 1955 Edition, together with the December 1957 amendments, published by the National Board of Fire Underwriters; (2) those standards described and required by the Fire Prevention Code, 1960 Edition, published by said National Board of Fire Underwriters; or (3) those standards prescribed in the technical codes of the City of Wichita.

    The term NEW CONSTRUCTION shall mean the erection of any new building or other facility either (1) detached from existing buildings or facilities, or (2) attached but constituting a substantial enlargement of ground surface area or cubical content of an existing building or facility.

    All other words and phrases herein shall be given the same meaning as they would have under the provisions of the said technical codes.
