§ 14.08.055. Industrial compliance certificate.

  • Any industry operating within an industrial district formed under this chapter shall be entitled to receive an industrial compliance certificate and to the benefits thereof under Chapter 14.04 of this code without being required to meet the conditions of Section 14.04.040 of said code if the industry meets the following requirements, and provided further that the industry will comply within one year after receiving temporary approval as set out herein:

    (a)

    The industry maintains its home offices within the industrial district;

    (b)

    The industry employs at least five hundred employees within the industrial district;

    (c)

    The industry maintains valid public liability insurance, written by a company or companies authorized to do business in the state of Kansas, with limits of not less than fifty thousand dollars for injury or death of any person, of not less than one hundred thousand dollars for property damage in any one occurrence, and of not less than three hundred thousand dollars in aggregate limits for any one occurrence; and

    (d)

    The industry submits an affidavit to the central inspection superintendent certifying that it meets requirements (a) through (c) of this section, and that its technical activities are conducted in compliance with acceptable standards, as defined at Section 14.04.020, and an application fee of one hundred dollars is submitted with the affidavit.

    Thereupon, the central inspection superintendent shall issue to the industry a temporary industrial compliance certificate evidencing the industry's compliance with Chapter 14.04 of this code.

    An industry holding an industrial compliance certificate under this chapter shall file annually a renewal fee of fifty dollars, and an affidavit stating that the industry continues to meet requirements (a) through (c) of this section. Failure to submit the affidavit and pay the fifty dollar renewal fee within thirty days after written notice of delinquency shall require the central inspection superintendent to cancel the industry's industrial compliance certificate.
